{"id":194041,"date":"2024-02-20T16:25:13","date_gmt":"2024-02-20T16:25:13","guid":{"rendered":"https:\/\/www.musicbusinessworldwide.com\/?p=194041"},"modified":"2024-02-20T18:34:54","modified_gmt":"2024-02-20T18:34:54","slug":"major-labels-1bn-copyright-win-against-cox-communications-overturned-on-appeal","status":"publish","type":"post","link":"https:\/\/www.musicbusinessworldwide.com\/major-labels-1bn-copyright-win-against-cox-communications-overturned-on-appeal\/","title":{"rendered":"Major labels&#8217; $1bn copyright win against Cox Communications overturned on appeal"},"content":{"rendered":"<p>The major labels&#8217; USD $1 billion copyright infringement victory against Cox Communications has been overturned.<\/p>\n<p>A federal appeals court in Virginia has rejected parts of the 2019 verdict against Cox Communications, in which a jury found the cable and internet company \u2013 the third-largest provider of broadband services in the US, as of 2022 \u2013 liable for copyright infringement of 10,017 musical works by its subscribers.<\/p>\n<p>The 4th US Circuit Court of Appeals has ordered a new trial to be held, after concluding that the <strong>$1 billion<\/strong> penalty against Cox was not justified, <a href=\"https:\/\/www.reuters.com\/legal\/cox-communications-wins-order-overturning-1-bln-us-copyright-verdict-2024-02-20\/\" target=\"_blank\" rel=\"noopener\"><em>Reuters<\/em> first reported<\/a> on Tuesday (February 20).<\/p>\n<p>The court said in its <a href=\"https:\/\/www.musicbusinessworldwide.com\/files\/2024\/02\/Cox-Communications-4th-Circuit-opinion-1-1.pdf\">ruling <\/a>on Tuesday: &#8220;We affirm the jury\u2019s finding of willful contributory infringement. But we reverse the vicarious liability verdict and remand for a new trial on damages because Cox did not profit from its subscribers\u2019 acts of infringement, a legal prerequisite for vicarious liability.&#8221;<\/p>\n<p><span style=\"font-weight: 400\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__tweeny hidden-xs hidden-ms hidden-sm\" data-loaded=\"no\" data-sizes=\"992 1200 1440\" data-name=\"628x90 Sponsor banner #5 (992+1200+1440)\" data-params=\"dfp_sponsor5_628\" id=\"dfp_sponsor5_628\"><\/div>      <div class=\"mb-advert mb-advert__banner mb-advert__banner--inline hidden-xs hidden-sm hidden-md hidden-lg\" data-loaded=\"no\" data-sizes=\"480\" data-name=\"468x60 Sponsor banner #5 (480)\" data-params=\"dfp_sponsor5_468\" id=\"dfp_sponsor5_468\"><\/div>      <div class=\"mb-advert mb-advert__mobile mb-advert__mobile--inline hidden-ms hidden-md hidden-lg\" data-loaded=\"no\" data-sizes=\"320 768\" data-name=\"300x50 Sponsor banner #5 (320+768)\" data-params=\"dfp_sponsor5_300\" id=\"dfp_sponsor5_300\"><\/div>      <\/div>      <\/span><\/p>\n<p>The lawsuit, filed in a federal court in Virginia in 2018, included numerous plaintiffs from the music industry, including <strong>Sony Music Entertainment<\/strong> (the lead plaintiff), <strong>Universal Music Group<\/strong> and <strong>Warner Music Group<\/strong>.<\/p>\n<p>The music companies argued that Cox Communications \u201cknowingly contributed to, and reaped substantial profits from, massive copyright infringement committed by thousands of its subscribers.\u201d<\/p>\n<p>\u201cCox received hundreds of thousands of notices of infringement and did not adequately respond or comply with its obligations to stop its subscribers from infringing on peer to peer networks,\u201d <strong>National Music Publishers\u2019 Association<\/strong> (NMPA) President <strong>David Israelite<\/strong> said at the time.<\/p>\n<p><span style=\"font-weight: 400\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__spu\" data-loaded=\"no\" data-name=\"300x250 Sponsor MPU #1\" data-params=\"dfp_spu1\" id=\"dfp_spu1\"><\/div>      <\/div>      <\/span><\/p>\n<p>Jurors sided with the music industry plaintiffs, awarding <strong>$99,830.29<\/strong> for each of the more than 10,000 infringed works.<\/p>\n<p>Cox called that judgment \u201cunwarranted, unjust and an egregious amount,\u201d and <a href=\"https:\/\/www.musicbusinessworldwide.com\/major-labels-billion-dollar-payday-under-fire-as-cox-communications-argues-against-shockingly-excessive-damages-ruling\/\" target=\"_blank\" rel=\"noopener\">challenged the ruling<\/a> in January 2020. However, the following June, US District Judge Liam O\u2019Grady <a href=\"https:\/\/www.musicbusinessworldwide.com\/majors-1bn-lawsuit-against-cox-communications-upheld-by-judge\/\" target=\"_blank\" rel=\"noopener\">rejected the company&#8217;s assertion <\/a>that the damages awarded for each infringed copyright were \u201cexcessive\u201d.<\/p>\n<p>Cox then took the matter to the 4th Circuit appeals court, telling the court that the verdict meant that internet service providers (ISPs) would have to disconnect households and businesses from their internet services based on &#8220;isolated and potentially inaccurate allegations,&#8221; or would require ISPs to spy on their customers\u2019 internet usage, according to <em>Reuters<\/em>.<\/p>\n<p><span style=\"font-weight: 400\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__spu\" data-loaded=\"no\" data-name=\"300x250 Sponsor MPU #2\" data-params=\"dfp_spu2\" id=\"dfp_spu2\"><\/div>      <\/div>      <\/span><\/p>\n<p>In the opinion handed down Tuesday, the appellate court contradicted the lower court&#8217;s ruling that Cox Communications had profited from their subscribers&#8217; infringement of copyrights.<\/p>\n<p>The payment of monthly fees by subscribers to Cox&#8217;s internet service, &#8220;even by repeat infringers, was not a financial benefit flowing directly from the copyright infringement itself,&#8221;
