{"id":144528,"date":"2022-12-16T18:06:18","date_gmt":"2022-12-16T18:06:18","guid":{"rendered":"https:\/\/www.musicbusinessworldwide.com\/?p=144528"},"modified":"2022-12-16T18:38:08","modified_gmt":"2022-12-16T18:38:08","slug":"bmg-universal-and-concord-sue-internet-service-operator-altice-usa-for-alleged-copyright-infringement-with-potential-damages-exceeding-1bn12","status":"publish","type":"post","link":"https:\/\/www.musicbusinessworldwide.com\/bmg-universal-and-concord-sue-internet-service-operator-altice-usa-for-alleged-copyright-infringement-with-potential-damages-exceeding-1bn12\/","title":{"rendered":"Music companies hit internet service operator Altice USA with $1bn copyright infringement lawsuit"},"content":{"rendered":"<p>Internet service operator Altice, which owns the Optimum broadband and cable brand, has become the latest US IP to be hit with a copyright infringement lawsuit alleging multiple incidents of music piracy via its services.<\/p>\n<p>Claimed to be one of the &#8220;largest connectivity providers in the US&#8221;, internet provider <a href=\"https:\/\/www.alticeusa.com\/\" target=\"_blank\" rel=\"noopener\">Altice USA<\/a> has more than 5 million customers in 21 US states.<\/p>\n<p>The lawsuit was filed on Wednesday (December 14) in Texas by a number of rightsholders, including BMG, as well as Universal Music, Capitol Records and Concord Music Group.<\/p>\n<p>They&#8217;re suing Optimum&#8217;s owner over &#8220;millions&#8221; and that the &#8220;BitTorrent protocol enables a uniquely efficient means for facilitating illegal file sharing&#8221;.<\/p>\n<p class=\"p1\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__spu\" data-loaded=\"no\" data-name=\"300x250 Sponsor MPU #2\" data-params=\"dfp_spu2\" id=\"dfp_spu2\"><\/div>      <\/div>      <\/p>\n<p>BMG, UMG and Concord claim that using BitTorrent, Altice\u2019s subscribers &#8220;have pirated many thousands of sound recordings and musical compositions that are protected by copyrights and equivalent rights owned by or exclusively licensed to Plaintiffs&#8221;.<\/p>\n<p>They claim further that Altice, &#8220;has received over a million notices of infringement of Plaintiffs\u2019 works by Altice subscribers&#8221; and that those notices concerned &#8220;close to 20,000&#8221; of Altice&#8217;s subscribers.<\/p>\n<p>&#8220;Many of these are not just one-time offenders,&#8221; the filing adds. &#8220;They are chronic and repeat infringers.&#8221; Altice allegedly &#8220;turned a blind eye&#8221; after receiving those notices.<\/p>\n<p>&#8220;The scope and volume of infringing activity taking place using the Altice services illustrates that, rather than terminating repeat infringers\u2014and losing revenue attributable to those subscribers\u2019 monthly fees \u2014 Altice simply looked the other way,&#8221; states the rightsholders claim.<\/p>\n<p>It notes further that the law &#8220;is clear that a party that knowingly and materially assists someone engaging in copyright infringement faces liability for that infringement&#8221;.<\/p>\n<p>The plaintiffs are seeking damages of up to $150,000 for each of the infringed works. The &#8216;Exhibit A&#8217; document filed along with the claim, which you can <a href=\"https:\/\/www.musicbusinessworldwide.com\/files\/2022\/12\/Exhibit-1.pdf\">view here<\/a>, lists over 7,000, meaning damages sought by BMG, UMG and Concord could exceed $1 billion.<\/p>\n<hr \/>\n<p>This latest case follows several other high-profile cases and settlements addressing infringement by subscribers using the services of internet providers including Grand Communications, Cox Communications and Bright House Networks\/Charter.<\/p>\n<p><a class=\"link-relationship\" style=\"background: 0px 0px;color: unset !important;text-decoration: none;border-bottom: 1px dashed #ff7d00\" title=\"Companies &gt; BMG [835 articles]\" href=\"https:\/\/www.musicbusinessworldwide.com\/companies\/bertelsmann\/bmg\/\">In 2018, BMG<\/a> <a href=\"https:\/\/www.musicbusinessworldwide.com\/bmg-accepts-substantial-settlement-in-legal-battle-with-isp-cox-communications\/\" target=\"_blank\" rel=\"noopener\">settled<\/a> a long-running copyright infringement case against the third biggest ISP in the US, Cox Communications, for a \u201csubstantial\u201d sum.<\/p>\n<p>That same year, Universal,\u00a0Sony\u00a0and\u00a0Warner filed a lawsuit against the ISP, accusing it at the time of having \u201cknowingly contributed to, and reaped substantial profits from, massive copyright infringement committed by thousands of its subscribers\u201d.<\/p>\n<p>In December 2019, a jury decided that the firm was\u00a0<a class=\"link-internal\" href=\"https:\/\/www.musicbusinessworldwide.com\/cox-communications-fined-1bn-after-losing-copyright-infringement-lawsuit\/\" target=\"_blank\" rel=\"noopener noreferrer\">liable for the infringement of over 10,000 music copyrights by its users<\/a>\u00a0and it was ordered to pay the labels over $99,000 for each of the 10,017 alleged works that were infringed \u2013 the equivalent of <strong>$1 billion<\/strong> in collective damages.<\/p>\n<p>In August, a\u00a0number of record labels, including\u00a0<a class=\"link-relationship\" style=\"background: 0px 0px;color: unset !important;text-decoration: none;border-bottom: 1px dashed #ff7d00\" title=\"Companies &gt;
